These Terms and Conditions govern your use of galagulaab.com (the "Website") and your purchase of products from Gala Gulaab. For any questions, please contact us at customercare@galagulaab.com.
By browsing our Website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our Website. A copy of these Terms will be included in your order confirmation email for your records.
2. Our Products
Gala Gulaab designs and sells jewellery. While we make every effort to accurately represent our products through images and descriptions on the Website, colours and proportions may vary depending on your screen settings and device. Product images are for illustrative purposes only. We do not guarantee that your screen's display of any colour will perfectly reflect the actual product.
Each piece may carry natural variations in appearance. These are not defects but are inherent to the nature of our jewellery.
We reserve the right to withdraw any product from sale at any time and to modify product descriptions or pricing without prior notice, subject to any orders already confirmed.
3. Orders
3.1 By placing an order on our Website, you are making an offer to purchase the selected products at the stated price. You are responsible for ensuring that all order details, including your delivery address and contact information, are complete and accurate.
3.2 A contract between you and Gala Gulaab is formed when we send you a dispatch notification confirming that your order has been shipped. An email acknowledging receipt of your order does not constitute acceptance of that order.
3.3 We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, stock unavailability, suspected fraud, or payment issues. If we cancel your order after payment has been processed, we will issue a full refund promptly.
3.4 All products purchased from Gala Gulaab are for personal use only. You warrant that you are not purchasing products for commercial resale or any other commercial purpose.
3.5 You warrant that you are at least 18 years of age and are legally capable of entering into binding contracts.
4. Pricing & Payment
4.1 All prices displayed on the Website are shown in Euros (EUR) and are subject to change without notice. The price applicable to your order is the price displayed at the time of placing your order.
4.2 We accept the following payment methods: Visa, Mastercard, American Express, Maestro, UnionPay, Shop Pay, Apple Pay, Google Pay, and Klarna.
4.3 Full payment is required at the time of placing your order. By submitting your payment details, you confirm that you are authorised to use the payment method provided.
4.4 All transactions are processed securely through Shopify Payments. Gala Gulaab does not store your card details.
4.5 If you choose to pay using Klarna, Klarna's own terms and conditions will apply to that element of your transaction. Gala Gulaab accepts no responsibility for Klarna's services, lending decisions, or payment schedules.
4.6 Prices displayed include applicable VAT where required by law. For customers outside the EU, VAT may be deducted at checkout. Please refer to Section 7 (Customs & Duties) for further information on taxes applicable to your order.
4.7 Despite our best efforts, pricing errors may occasionally occur. If we identify a pricing error after your order has been placed, we will contact you before proceeding. You will have the option to confirm your order at the correct price or cancel it for a full refund.
5. Delivery & Shipping
5.1 We ship to countries within Europe, the United Kingdom, and the United States of America.

5.3 Orders are fulfilled and dispatched via our logistics partner. You will receive a confirmation email with your tracking information once your order has been dispatched.
5.4 Delivery timeframes are estimates only and may be subject to delays beyond our control, including carrier delays, customs clearance processes, or force majeure events. Gala Gulaab does not accept liability for delays caused by circumstances outside our reasonable control.
5.5 Title to the goods passes to you upon receipt of full payment. Risk in the goods passes to you upon delivery to the address specified in your order.
5.6 If you provide an incorrect or incomplete delivery address and the parcel cannot be delivered, Gala Gulaab shall not be liable for any resulting loss. Any costs incurred in re-routing or re-delivering the order may be charged to you.
6. Returns & Refunds
6.1 You have the right to cancel your order within 14 calendar days of receiving your products, without providing a reason, in accordance with applicable consumer protection law.
6.2 To exercise your right of cancellation, please contact us at customercare@galagulaab.com within the 14-day period, quoting your order number. You may also use the standard withdrawal form provided in section 6.7 of these Terms, though this is not mandatory — any clear written statement expressing your wish to cancel is sufficient. Once your cancellation is confirmed, please return the products to us without undue delay and no later than 14 days from the date of your cancellation notification.
6.3 Products must be returned in their original condition — unworn, undamaged, and in original packaging. We reserve the right to refuse returns or apply a proportional deduction to your refund if items show signs of wear or damage beyond what is necessary to assess the product.
6.4 Upon receipt and inspection of the returned items, we will issue a full refund to your original payment method within 14 days.
6.5 Return shipping costs are the responsibility of the customer, unless the item is faulty or incorrect. We recommend using a tracked and insured shipping service, as Gala Gulaab cannot accept liability for items lost or damaged in transit on return.
6.6 If you have received a faulty or incorrect item, please contact us at customercare@galagulaab.com with your order number and photographs of the issue as soon as possible after receipt. We will cover return shipping costs for approved claims.
6.7 To exercise your right of cancellation, you may use the form below. Use of this form is not mandatory — any clear written statement sent to customercare@galagulaab.com is sufficient.

7. Customs & Duties
7.1 For orders delivered within the European Union, all applicable taxes are included in the price displayed at checkout.
7.2 For orders delivered to the United Kingdom, import duties and taxes may apply as the UK is no longer part of the EU customs territory. These charges are outside our control and are the sole responsibility of the customer. Please check with your local customs authority before placing your order.
7.3 For orders delivered to the United States, customs fees or import charges may apply depending on the order value and applicable thresholds. These charges are the sole responsibility of the customer. Gala Gulaab has no control over customs processes and cannot be held liable for delays caused by customs clearance.
7.4 If a parcel is refused or unclaimed due to unpaid customs charges and is returned to us, we reserve the right to deduct any associated return shipping costs from your refund.
8. Your Statutory Rights
8.1 As a consumer, you are entitled to a three-year statutory guarantee against defects in accordance with applicable Spanish and EU consumer law (Real Decreto Legislativo 1/2007, as amended by Real Decreto-ley 7/2021, and EU Directive 2019/771). This guarantee applies from the date of delivery.
8.2 If your product is defective or does not conform to what was described at the time of purchase, please contact us at customercare@galagulaab.com within a reasonable time of discovering the defect. We will offer a repair, replacement, price reduction, or refund as appropriate to the circumstances.
8.3 This statutory guarantee does not cover damage resulting from misuse, accidents, normal wear and tear, improper care, or exposure to chemicals, perfumes, water, or other substances.
8.4 Nothing in these Terms affects your statutory rights as a consumer.
9. Intellectual Property
9.1 All content on this Website — including but not limited to images, photographs, text, designs, logos, product names, and branding — is the property of Gala Gulaab and is protected by applicable intellectual property laws.
9.2 You may not reproduce, distribute, modify, display, or otherwise use any content from this Website for commercial purposes without our prior written consent.
9.3 You may view and download content for your own personal, non-commercial use only, provided that all proprietary notices remain intact.
9.4 Any unauthorised use of Gala Gulaab's intellectual property may result in legal action.

11. Limitation of Liability
11.1 Nothing in these Terms shall limit or exclude our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded under applicable law.
11.2 Subject to clause 11.1, our total liability to you in connection with your purchase shall not exceed the total amount paid by you for the products in question.
11.3 We are not liable for indirect or consequential losses, including loss of profit, loss of data, or any loss not arising directly and foreseeably from our breach.
12. Force Majeure
We shall not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure arises from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, industrial action, war, civil unrest, fire, flood, or disruption to transport or communications networks. We will inform you as soon as reasonably possible if such circumstances affect your order and will work to find a suitable resolution.
13. General
Entire Agreement. These Terms constitute the entire agreement between you and Gala Gulaab in relation to your purchase and supersede all prior discussions, representations, and agreements.
Severability. If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if that is not possible, it shall be removed. The remaining provisions shall continue in full force and effect.
Waiver. Our failure to enforce any provision of these Terms at any time shall not be construed as a waiver of that or any other provision.
Changes to These Terms. We reserve the right to update these Terms at any time. The updated version will be posted on this page with a revised date. For material changes, we will endeavour to provide reasonable advance notice. Your continued use of the Website after changes take effect will be taken as your acceptance of the updated Terms, without prejudice to any rights you have as a consumer.
14. Governing Law & Dispute Resolution
14.1 These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Spain.
14.2 Any disputes shall be subject to the jurisdiction of the courts of Barcelona, Spain, without prejudice to clause 14.3.
14.3 If you are a consumer resident within the European Union, you retain the right to bring proceedings before the courts of your country of habitual residence. You may also seek to resolve disputes through the EU Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr
